Introduction

Zenith Group NW LLC, doing business as Zenith Homes and Pinnacle Construction (collectively, “Zenith,” the “Company,” “we,” “us,” or “our”), respects the privacy of our customers, prospective customers, website visitors, and users of our online services.

This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you interact with us, including through builtbyzenith.com, pinnaclepnw.com, subdomains of those websites, customer portals, website forms, telephone communications, email, SMS or MMS messaging, and other related online services operated by or on behalf of the Company (collectively, the “Online Services”).

Certain state privacy laws may provide specific rights to residents of those states. The availability and scope of those rights depend upon applicable law and may be subject to exemptions or limitations. While we may voluntarily respond to privacy requests from individuals who are not entitled to statutory rights, doing so does not create rights beyond those provided by applicable law.

Depending upon how you interact with us, we may collect the following categories of information:

Profile and Interaction Information Information regarding your interactions with our websites, communications, products, services, advertisements, forms, and customer-service tools. Understanding customer interests, prioritizing inquiries, improving customer experience, customer relationship management, analytics, and marketing where permitted.
Communications Emails, SMS/MMS messages, telephone communications, chat interactions, customer-service inquiries, form submissions, and other communications with us. Responding to inquiries, providing customer service, documenting customer relationships, administering projects and transactions, and sending communications you have requested or consented to receive.

2. How We Collect Information

We may collect personal information:

  • Directly from you when you submit a website form, request information, contact us, visit our offices, enter into a transaction, or otherwise provide information to us;
  • Through telephone calls, email, SMS/MMS, chat, and other communications;
  • Through our websites, customer portals, cookies, analytics tools, and similar technologies;

3. Online Forms and Form Interactions

When you interact with an online form, we may collect information you enter into the form, including in some circumstances information entered before the form is formally submitted.

We may use such information to understand interest in our homes and services, improve our websites and customer experience, provide assistance with an inquiry, maintain security, and follow up where permitted by law.

Providing a telephone number through a general inquiry form does not, by itself, constitute consent to receive recurring or promotional SMS or MMS messages. Where SMS consent is required, consent will be requested separately through an affirmative opt-in mechanism.

You may request deletion or correction of personal information collected through our forms by contacting privacy@zenithgroupnw.com, subject to applicable legal and operational retention requirements.


4. SMS and MMS Privacy

Zenith Group NW LLC may communicate by SMS or MMS under the Zenith Homes or Pinnacle Construction trade names. We may offer users the opportunity to affirmatively consent to receive text messages from us.

Depending upon the consent provided and your relationship with us, messages may include conversational communications, responses to inquiries, appointment reminders, customer-service communications, project updates, transaction-related information, informational notices, and promotional or marketing messages.

Consent to receive marketing or promotional text messages is voluntary and is not a condition of purchasing any product or service.

Where consent is collected through a website or electronic form, the SMS consent mechanism will be separate from acceptance of general terms or other required actions and will not be pre-selected on your behalf.

An opt-out request applies to the messaging program or number as required by applicable law, carrier requirements, or messaging-provider rules. We will honor applicable SMS opt-out requests and maintain records of consent and opt-out activity as reasonably necessary for compliance and operational purposes.

We do not sell, rent, or share mobile telephone numbers, SMS/MMS opt-in information, or messaging consent with third parties or affiliates for their own marketing or promotional purposes.

All categories of information sharing described elsewhere in this Privacy Policy exclude SMS/MMS originator opt-in data and messaging consent to the extent such sharing would be for third-party or affiliate marketing or promotional purposes.

We may disclose mobile information to vendors and service providers that assist us in providing messaging services, such as telecommunications providers, messaging platforms, customer relationship management systems, and technology service providers, solely as reasonably necessary to provide services on our behalf, maintain security, comply with law, or operate our communications systems. Such service providers are not authorized by us to use SMS opt-in information for their own marketing or promotional purposes.


5. Cookies, Analytics, and Tracking Technologies

Our Online Services may use cookies, pixels, scripts, local storage, analytics technologies, and similar technologies to operate our websites, remember preferences, understand visitor activity, measure website performance, protect against abuse, and support marketing or advertising activities.

Information collected through these technologies may include IP address, browser type, device characteristics, operating system, referring website, pages viewed, interactions with website features, approximate location derived from IP address, session information, and unique device or browser identifiers.

Google Analytics

We use Google Analytics and related services to understand how visitors interact with our Online Services, measure traffic and website performance, and improve our services. Google may receive information regarding your device, browser, IP address, and interactions with our websites in connection with providing these services.

Google reCAPTCHA

We use Google reCAPTCHA to help protect our websites against spam, abuse, fraudulent activity, and automated submissions. reCAPTCHA may collect hardware and software information, device and application data, IP address, and interaction information and transmit such information to Google for analysis.

Information processed by Google in connection with these services is subject to Google’s applicable privacy policy and terms.

Zoho SalesIQ and Related Zoho Services

We use Zoho SalesIQ and related Zoho services for customer communications, website interaction analysis, customer relationship management, marketing, email and SMS communications, and related business functions.

These services may collect or process contact information, website interaction information, device information, chat or communication history, customer relationship information, and other information reasonably necessary to provide those services.


6. How We Use Personal Information

We may use personal information for purposes including:

  • Responding to inquiries and requests;
  • Providing customer service and support;
  • Communicating regarding homes, products, services, projects, appointments, transactions, and customer relationships;
  • Preparing estimates, proposals, contracts, project information, and related materials;
  • Administering customer accounts and portals;
  • Providing email, SMS, and other communications where authorized or permitted;
  • Understanding customer interests and improving the customer experience;
  • Operating, maintaining, securing, and improving our Online Services;
  • Conducting analytics and measuring website performance;
  • Preventing fraud, spam, abuse, security incidents, and unauthorized activity;
  • Debugging and troubleshooting technical issues;
  • Maintaining business and transaction records;
  • Conducting internal research and business analysis;
  • Marketing and advertising our products and services where permitted;
  • Complying with applicable legal, regulatory, contractual, and recordkeeping requirements; and
  • Protecting the rights, property, safety, and security of the Company, our customers, and others.

7. Automated Processing and Profiling

We may use technology, including Zoho SalesIQ and related services, to analyze interactions with our Online Services, categorize or prioritize inquiries, understand interests, and assist with customer relationship management and marketing activities.

Such technology may create inferences concerning a user’s interests or interactions. We do not represent that automated processing will be used to make legally significant decisions concerning an individual without human involvement where doing so would be prohibited by applicable law.


8. Disclosure of Personal Information

We may disclose personal information to service providers and other parties reasonably necessary to operate our business and provide our products and services, including:

  • Cloud storage and hosting providers;
  • Website hosting and technology providers;
  • Analytics and advertising providers;
  • Email distribution and communications providers;
  • SMS/MMS and telecommunications service providers;
  • Customer relationship management providers;
  • Customer-service and help-desk providers;
  • Cybersecurity and authentication providers;
  • Accounting and financial service providers;
  • Manufactured-home manufacturers and suppliers;
  • Contractors, subcontractors, installers, repair providers, and warranty providers;
  • Property inspection, engineering, permitting, logistics, and project-planning providers;
  • Lenders or financing providers when requested or authorized by you or reasonably necessary in connection with a transaction;
  • Government agencies or other parties where disclosure is required or permitted by law; and

Service providers may process personal information on our behalf in connection with the services they provide to us.

Notwithstanding the foregoing, mobile telephone numbers and SMS/MMS opt-in or consent information are not sold or shared with third parties or affiliates for their own marketing or promotional purposes.


9. Sale or Sharing for Targeted or Cross-Context Behavioral Advertising

We do not sell personal information for money in the ordinary meaning of the word “sell.”

However, some state privacy laws define “sale,” “sharing,” or “targeted advertising” broadly enough that the use of certain advertising, analytics, cookies, pixels, or similar technologies may constitute a sale or sharing of personal information even when no money is exchanged.

Depending upon the technologies in use, categories of information potentially subject to such treatment may include:

  • IP addresses and online identifiers;
  • Device characteristics and unique device identifiers;
  • Internet or browsing activity;
  • Interactions with our websites or advertisements; and
  • Approximate location information derived from an IP address.

Such information may be disclosed to analytics providers and advertising partners where permitted by applicable law.

You may submit a request to opt out of qualifying sale, sharing, or targeted advertising by contacting privacy@zenithgroupnw.com and informing us of your request.

SMS/MMS opt-in data, mobile telephone numbers, and messaging consent are excluded from this advertising-related sharing and are not sold or shared for third-party or affiliate marketing or promotional purposes.


10. Data Retention

We retain personal information for different periods depending upon the purposes for which it was collected and used.

We generally retain information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, administer customer relationships and transactions, maintain business records, comply with applicable requirements, resolve disputes, enforce agreements, maintain security, and protect legitimate business interests.

When information is no longer reasonably necessary, we may delete, anonymize, or de-identify it, subject to legal, contractual, technical, backup, security, and operational requirements.

Where technical or operational limitations prevent immediate deletion, we may take reasonable measures to restrict further use of the information until deletion or de-identification is feasible.

No internet transmission, electronic storage system, or security measure can be guaranteed to be completely secure. Accordingly, we cannot guarantee absolute security of personal information.


12. International Processing

Zenith primarily operates within the United States. However, some service providers, technology vendors, cloud providers, or their subcontractors may store or process information in other countries.

Where personal information is processed outside the United States, we take reasonable steps appropriate to the circumstances to require that information be handled consistently with this Privacy Policy and applicable law.


13. Children and Minors

Our products and transactional Online Services are intended for adults. Customers must be at least eighteen (18) years old to enter into transactions with the Company.

We do not knowingly solicit personal information from children under thirteen (13), and we do not knowingly sell or share the personal information of minors under sixteen (16) for targeted or cross-context behavioral advertising.

  • Appeal certain decisions regarding privacy requests where applicable law provides such a right.

These rights are subject to applicable exemptions, verification requirements, legal limitations, and other conditions imposed by law.

17. Marketing Opt-Out Requests

You may request to opt out of non-SMS marketing communications by emailing optout@zenithgroupnw.com or by using an unsubscribe mechanism included in an applicable marketing email.

SMS and MMS opt-out requests should be made by replying STOP to the applicable text-message conversation. You may also contact privacy@zenithgroupnw.com for assistance.

Opting out of marketing communications does not necessarily prevent us from sending communications reasonably necessary to administer a current transaction, contract, customer relationship, project, warranty, account, or other non-marketing matter where permitted by law.


18. Opt-Out Preference Signals

Certain state privacy laws require businesses to recognize qualifying browser-based universal opt-out mechanisms or opt-out preference signals, such as Global Privacy Control (“GPC”), in certain circumstances.

Where applicable law requires us to recognize such a signal and our systems are capable of receiving it, we will process the signal in accordance with applicable requirements.

Because browser-based signals generally apply to the browser or device transmitting the signal, you may need to enable the signal separately on different browsers or devices.


19. Third-Party Websites and Services

Our Online Services may contain links to websites, platforms, services, manufacturers, lenders, contractors, social networks, or other resources operated by third parties.

We do not control the privacy practices of independent third parties. Information you provide directly to a third party is generally governed by that third party’s privacy policy and terms.
